ATTENTION: These terms and conditions ("Terms") are posted here by MediaTel Limited ("we", "our" or "us"). Please read these Terms carefully as they apply to the supply of any Report(s) by us.
Scope
These Terms contain the full understanding between the person whose details appear in the order form ("you" or "your") linked to these Terms and us with respect to your request for the supply of the intelligence reports compiled by us and advertised over these web pages ("Report(s)"). Any terms contained in any other document received by you from us which are inconsistent with these Terms shall not affect these Terms in any way and these Terms shall prevail. In addition, no course of conduct between you and us shall act so as to modify the provisions of these Terms.
Acceptance of Terms
By completing the order form and by clicking on the "Purchase Now" button you are (i) requesting us to provide you with one or more Report(s); (ii) confirming that you accept these Terms in full; and (iii) accepting that these Terms will govern any subsequent agreement that may come into existence between you and us with respect to the Report(s).
Placing an Order
Email Order Confirmation:
After you have clicked on the "Purchase Now" button we will send you an email confirming that we have received your request and confirming the details of your request. Receipt of this email from us is our confirmation to you that we accept your request for the Report(s) at which time a legally enforceable contract will come into force between you and us.
Report(s) Delivery:
We will send the Report(s) to you in pdf format to the email address details supplied by you in the order form, as an attachment to an email.
Whilst we will use our reasonable commercial endeavours to ensure that the Report(s) reach you as soon as possible after payment is received, we cannot guarantee this. We will not be held liable for any loss or damage that you may suffer as a result of a delay in delivery or a failure to deliver. In the event that we are unable to deliver the Report(s) to you due to any inaccuracy in the delivery information supplied by you then any obligation to deliver the Report(s) to you will cease until such time as you have provided us with corrected information and in addition paid to us any reasonable additional delivery charges that we may have or need to incur.
Charges and Payment
Cancellation:
On receipt of an email order confirmation from us you cannot cancel your request for the Report(s) unless we otherwise agree. At this time you are legally obliged to pay us for the Report(s) you have requested.
Payment by Credit/Debit Card:
Payment can be made by credit/debit card using PayPal.
MediaTel Group advise you not to pay using American Express. Paypal accepts payments by American Express cards, but the payment will be converted into US$ and back to GBP, and may result in the payment shown on your credit/debit card statement being different to the amount you are invoiced. Invoices will be sent to the billing address you have supplied.
Payment by Invoice:
Invoices will be sent to the billing address you have supplied. Invoices are payable by you without deduction within thirty [30] days of the invoice date. If any payment due from you is late then you agree that we may charge you interest on any outstanding amount at a rate of 2% above the current base lending rate of the Bank of England as published from time to time, per month, from the date payment was due until the date payment is received.
Refunds:
Refunds will not be given under any circumstances.
Updates
We sometimes update the Report(s) we produce and we sometimes advertise these updates in advance of the publication date. We also allow discounts to customers that purchase both Report(s) and advertised updates at the same time. You understand and agree that we are under no obligation to produce any update either on the suggested publication date or at all. If you have requested and paid for an update then you agree that our only obligation to you under this agreement with respect to the update is to refund you that part of the price you have already paid to us that relates to the relevant update.
Copyright and Intellectual Property / Report Ownership
Copyright and all other intellectual property rights in the Report(s) shall at all times belong to us or to the third party that provided any content appearing in the Report(s) to us. You acknowledge that you may not copy, re-produce, re-distribute, re-transmit, publish or otherwise transfer or commercially exploit the Report(s) or any part of the Report(s) without firstly obtaining our written permission to do so.
Reliance and Warranties
We give no warranties whatsoever with respect to the Report(s) and in particular we do not warrant the Report(s) accuracy and accept no liability for any loss that you may suffer as a result of your reliance on the Report(s) nor will we be responsible or liable to you for any consequences relating directly or indirectly to any action or inaction you take based on the Report(s).
Exclusion and Limitation of Liability
In so far as we are able to do so we exclude all liability and responsibility to you for any amount or kind of loss or damage that may result to you or any third party (including without limitation any loss of income, profits, opportunity, goodwill, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with your use of the Report(s). In addition and again in so far as we are able to do so we exclude liability for any and all direct, indirect or consequential loss or damages that result from your use of the Report(s).
For the avoidance of any doubt, nothing in these Terms shall exclude or limit our liability for (i) death or personal injury caused by our negligence; (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under applicable law.
In any event, you accept and agree that our maximum liability to you in connection with this agreement shall not exceed the total price paid to us by you for the Report(s).
Notices
Any notice served under these Terms shall be served in writing to the last notified address of the receiving party.

These Terms shall be binding upon and for the benefit of the successors in title of the parties hereto.
Should any of the provisions of these Terms be found by any Courts or other body of competent jurisdiction to be invalid or unenforceable then the invalidity or enforceability of such provisions shall not affect the other provisions and all provisions not affected shall remain in full force and effect. Both you and we agree to attempt to substitute for any invalid or unenforceable provision a valid or enforceable provision which achieves to the greatest extent possible, the economic, legal and commercial objectives of the invalid or unenforceable provision.
These Terms shall be governed by and construed in accordance with English law and you agree to submit to the exclusive jurisdiction of the English Courts.
